Resolution of claims and disputes by negotiation often brings about an acceptable solution for both parties. An expressed intention to negotiate must however be viewed as the beginning of an important process, rather than a conclusion to matters; and also, must not be allowed to stall the process of resolution. At the outset of negotiations, it is essential that there is careful planning with assessment of best and worst cases, appraisal and full knowledge of key events, facts and evidence, the contract, cause and effects on time and quantum. Negotiations should be led by an individual with strong negotiation skills capable of accurately evaluating and skilfully employing the most suitable strategy and bringing matters to a mutually satisfactory conclusion.
